YOUR RIGHTS

1. If the establishment in which you are working employees 20 and above employees (whether regular or temporary or hired by or through a contractor) and the establishment falls under the notified category as specified in Section (1) of the EPF & MP Act, 1952, the Act becomes applicable to your establishment on its own and if the establishment is not already registered and you have not been granted the membership under the Act, you can register a complaint against the establishment. In such situation, you have every right to gain membership under the Act.

2. If your employer deducts employer share of the contribution from your salary, it is a violation under the Act and you can register a complaint against the employer..

3. You have every right to fill your nomination form (Form 2) and to revise it as many times as you want.

4. You have every right to demand annual account slip every year and to verify its contents and to report to the office any discrepancy within a period of six months..

5. If you are an existing member of the Fund and you join a new organisation to which the Act is applicable and even if your pay (Pay means your basic wages plus DA plus retaining allowances if any and cash value of food concession) is above Rs. 6500/- then you do not fall under the category of excluded employee and your employer can not deny the membership under the Act.

6. If your employer is not forwarding your claims within 5 days of your submission to him, it is a violation under the Act and you can register a complaint against the employer.
